TERMS OF USE

1. Introductory Provisions

These Terms of Use (hereinafter referred to as "TOU" or "Terms") govern the rights and obligations between the Operator of the PRASENI.COM platform (hereinafter referred to as the "Site" or "Platform") and the users (hereinafter referred to as the "User" or "You"). These TOU incorporate by reference our Privacy Policy and Content Policy.

By accessing, registering for, or using the Site, you confirm that you have read, understood, and agree to be bound by these TOU. If you do not agree to these terms, you must leave the Site immediately.

The Operator reserves the right to modify these TOU at any time. Changes become effective upon publication on the Site and update of the "Last Updated" date. Your continued use of the Site after such changes constitutes acceptance of the new terms.

2. Eligibility and Protection of Minors

This Site is intended exclusively for persons over the age of 18. By using this Site, you solemnly declare that you have reached the age of 18 (or the age of majority in your jurisdiction) and have full legal capacity to enter into this agreement.

Zero Tolerance for Content Involving Minors: PRASENI.COM applies a zero-tolerance policy toward Child Sexual Abuse Material (CSAM). Any content depicting minors, or persons appearing to be minors, will be immediately deleted, the account will be banned, and the matter will be referred to law enforcement authorities, including organizations such as NCMEC or ASACP.

3. Nature of Service and Escort Prohibition

IMPORTANT NOTICE: PRASENI.COM is a platform for sharing digital content (photos, videos, text). It is strictly forbidden to use the Platform to offer, solicit, advertise, or facilitate prostitution, escort services, or any physical sexual services for compensation. The Platform is not intended for arranging in-person meetings. The Operator does not conduct criminal background checks on users. Users are not employees or representatives of the Operator. The Operator is not responsible for the conduct of users outside the online environment of the Site.

4. User Account and Security

During registration, you are required to provide truthful and up-to-date information. You are fully responsible for maintaining the confidentiality of your password. Sharing your account with other persons is prohibited and may lead to its suspension. The Operator reserves the right to delete accounts that have been inactive for more than 12 months.

5. Payment Terms and Billing

Certain parts of the Site and content are subject to a fee. Payments are processed through third parties (payment gateways).

• Billing Descriptor: Card payments will appear on your bank statement under the descriptor "[XXX]" or a similar payment gateway identifier.

• Authorization: By entering payment details, you authorize us and our payment processors (including Verotel) to charge the respective amount. In the case of a subscription, you agree to recurring payments until the subscription is canceled.

• Credits: Credit top-ups are available in the range of 5 EUR to 500 EUR. Credits are used to unlock content. Unused credits are forfeited upon account cancellation by the user or due to a breach of terms.

6. Complaints and Refund Policy

We strive for maximum user satisfaction.

• Subscription Cancellation: You may cancel your subscription at any time in your account settings. Cancellation prevents future charges but does not refund the already paid period.

• Refunds: Due to the nature of digital content, which is consumed immediately after purchase, we generally do not provide refunds unless required by law.

• Exceptions: If a technical error occurs (e.g., duplicate charge, content not accessible due to a system fault), please contact our support at admin@praseni.com. Each request is assessed individually.

• Chargebacks: Please always contact us first before contacting your bank for a chargeback. Unauthorized chargebacks are considered fraudulent activity and will lead to a permanent ban of your account and being blacklisted within the payment gateway network.

Consumer Information (Withdrawal from Contract): In accordance with Section 1837(l) of the Czech Civil Code (and EU directives), the user expressly agrees that digital content (subscriptions, videos, photos) will be made available before the expiration of the withdrawal period. By giving this consent, the user loses the right to withdraw from the contract within 14 days without giving a reason.

7. Prohibited Content and Moderation

Users must not upload, share, or promote content that includes:

• Persons under the age of 18 (or material giving that impression).

• Violence, rape, incest, necrophilia, bestiality (zoophilia).

• Non-consensual sexual content (revenge porn).

• Drugs and illegal substances (including slang terms like "chems," "slam").

• Spam, fraudulent offers, or advertising of other products without consent.

• Hate speech, racism, or discrimination.

Response to Reported Content: The Operator undertakes to review all reports of offensive or illegal content (Abuse Reports) within 24 hours of receipt. If a violation of terms is found, the content will be permanently removed, and the account of the user who uploaded it may be blocked without compensation.

8. Copyright and DMCA

All Site content (code, design, texts), except for content uploaded by users, is the property of the Operator. Content uploaded by users remains their property; however, by uploading it, you grant the Operator a non-exclusive, worldwide license to display and distribute it within the Platform.

Copyright Infringement Notice (DMCA): We respect the intellectual property of others. If you believe your work has been copied in a way that constitutes copyright infringement, please send us a notice containing a description of the work, the location on the site (URL), and your contact details to our email: admin@praseni.com. Upon receipt of a valid notice, we will promptly remove or disable access to the disputed content.

9. Disclaimer of Liability

The Site is provided "as-is." To the maximum extent permitted by Czech law, the Operator disclaims warranties regarding the availability, error-free nature, or suitability of the Site for a particular purpose. The Operator is not liable for damages caused by force majeure (e.g., internet outages, natural disasters, wars), hacker attacks, or actions of third parties. As an information society service provider (under Act No. 480/2004 Coll.), the Operator is not responsible for content stored by users if it has no knowledge of its illegality or if it acted promptly to remove it upon learning of such illegality.

10. Indemnification

You agree to indemnify and hold the Operator harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your breach of these Terms, your violation of the law, or your violation of third-party rights.

11. Biometric Data and Age Verification

To ensure safety and legal compliance, we use age and identity verification systems (e.g., comparing a selfie and an identity document). This data is not collected for commercial purposes but solely to fulfill legal obligations (e.g., Record Keeping Requirements under 18 U.S.C. § 2257 and Czech laws). Data is stored securely and is accessible only in the event of legal proceedings or at the request of authorities.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts in the Czech Republic.

Alternative Dispute Resolution (ADR): In the event of a consumer dispute arising from a purchase or service agreement that cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court settlement to the designated entity, which is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, Email: adr@coi.cz, Web: adr.coi.cz.
